Welcome to Rhíza. These Terms and Conditions (“Terms”) govern your use of our website at rhizamarket.com (“Site”), as well as any in-café services, marketplace purchases, and online ordering offered by Rhíza, LLC (“Rhíza,” “we,” “us,” or “our”), operating in Kissimmee, Florida.

By accessing or using our Site, placing an order, or visiting our café, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, please discontinue use of our Site and services.

Who may use our site

Our Site and services are intended for users who are at least 13 years of age. By using the Site, you represent and warrant that:

You have the legal authority to enter into these Terms on behalf of yourself or any entity you represent.
All information you provide to us is accurate, current, and complete.

We reserve the right to refuse service to anyone for any reason at any time, consistent with applicable law.

Products and services

3.1 Marketplace
Rhíza offers a curated selection of food, beverage, and lifestyle products through our in-store marketplace and online shop. Product availability is subject to change without notice. We reserve the right to limit quantities, discontinue products, or modify offerings at any time.
3.2 Café
Our café services are available at our Kissimmee, Florida location during posted operating hours. Hours, menus, and in-store offerings may change seasonally or without prior notice.
3.3 Table Reservations
Table reservations may be made through the Site. Reservations are subject to availability. We ask that you notify us at least 24 hours in advance if you need to cancel or modify a reservation. Repeated no-shows may result in restricted reservation privileges.
3.4 Online Ordering & Nationwide Shipping
Select marketplace products are available for shipping nationwide. Orders are processed Monday through Friday, excluding federal holidays. Estimated delivery times are provided at checkout and are not guaranteed. Rhíza is not responsible for delays caused by third-party carriers or circumstances outside our control (including weather, customs, or carrier disruptions).

By placing an order through our Site, you represent that all provided billing and shipping information is accurate. We accept the following payment methods:

Major credit and debit cards (Visa, Mastercard, American Express, Discover)
Digital wallets (Apple Pay, Google Pay, where available)
Any other methods indicated at checkout

All prices are listed in U.S. Dollars and are subject to applicable Florida sales tax. We reserve the right to cancel or refuse any order at our discretion, including in cases of pricing errors, suspected fraud, or product unavailability. If your order is cancelled after payment, a full refund will be issued to your original payment method.

Orders and payment

5.1 Shipping
Shipping costs and estimated delivery times are calculated and displayed at checkout. Risk of loss and title for products purchased from our Site pass to you upon delivery to the shipping carrier.
5.2 Returns & Refunds
We want you to love what you receive from Rhíza. If you are not satisfied with a product, please contact us within 7 days of receiving your order at hello@rhizamarket.com. Eligible items may be returned within 14 days of delivery in their original, unopened condition for a refund or exchange.
The following items are not eligible for return:

Perishable goods (fresh food, refrigerated items, or opened pantry products)
Items marked as final sale
Gift cards or store credit

Return shipping costs are the responsibility of the customer unless the item arrived damaged or incorrect, in which case we will provide a prepaid return label.

Shipping, returns & refunds

All content on this Site — including but not limited to text, images, logos, graphics, video, product photography, and the Rhíza name and brand — is the property of Rhíza, LLC and is protected by applicable U.S. and international intellectual property laws.

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on this Site without our prior written permission. Any unauthorized use of our intellectual property may result in legal action.

Intellectual property

When using our Site, you agree not to:

Use the Site for any unlawful purpose or in violation of any applicable law or regulation.
Transmit any content that is defamatory, obscene, harmful, or otherwise objectionable.
Attempt to gain unauthorized access to any portion of the Site or its related systems.

Rhíza does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third-party sites. Your use of third-party services is at your own risk.

THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Rhíza does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy or completeness of any content on the Site, including product descriptions, pricing, or availability.

Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, RHÍZA, LLC AND ITS MEMBERS, MANAGERS, EMPLOYEES, AGENTS, AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In no event shall Rhíza's total liability to you for all claims arising out of or relating to the use of the Site exceed the amount you paid to Rhíza in the 90 days preceding the event giving rise to the claim, or $100, whichever is greater.

Limitation of liability

You agree to indemnify, defend, and hold harmless Rhíza, LLC and its members, managers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Site or services; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

Indemnification

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Osceola County, Florida, under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction.

You and Rhíza each waive any right to a jury trial or class action participation with respect to any dispute arising under these Terms.

Governing Law & dispute resolution

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the “Last Updated” date at the top of this page. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
